2 Hours

This seminar will address national security law related issues, beginning with an examination of the national security structure and operation within the White House and of the national security interagency process. This seminar will also focus on the role of national security lawyers in the midst of an emergency or threat, and the authorities and processes that shape the response of decision makers in a national security crisis. Specific areas of study will include preventive detention, surveillance standards, enemy combatants, military commissions, the role of international tribunals, the targeting of foreign nationals for killings by drones, enhanced interrogation techniques, and the regulation of speech and association. Students will lead one class discussion and prepare a 20-page paper on a topic covered in the seminar.
